We need a bit endeavor to make the courts of the country smoke free. The advocates practicing in the Supreme Court as well as in the lower courts of the country are qualified and intelligent citizens of the country. Those who are enrolled as an advocate of the courts of the country have to go through intense and robust examination and interview process.  It is believed that the most qualified and intelligent citizens of the country are enrolled them to provide legal services. It is the perception of the common people of the country that the advocates do know well about laws, rules and regulations of any particular subject matter and moreover, they are in the best position to find out of any matter's merits and demerits in following the rules and regulations.

 

When the law graduates are enrolled as an advocate they are to go through in details of the Canons of Professional Conduct and Etiquette regarding the dignity and high standard of the profession. The advocates are well aware of their rights and duties as an advocate within the courts as well as in their social life.

The advocates are considered as ‘Learned’ and hence they are assumed to know the basics of keeping the court premises free of all sort of hazards. It is, in fact, the lawyers spend most of their working hours in the court premises. Supposedly, the court premises are to be clean, tidy and hazard free. Now the question is whether we as learned advocates are doing our best to keep our premises clean, tidy and hazard free. Before answering this question let us look at the current state of the court premises

 

The main premises of the Supreme Court of Bangladesh and the Bar Association building are old one required to be demolished. The annex building, the annex extension building and the Shohrawardi building are new buildings adjacent to the old bar association building accommodating large number of lawyers. To me this new buildings have not been established in pre-planned way rather been built up in piecemeal basis. These buildings are accommodating more advocates than its space. In each year, there are huge numbers of member getting permission to practice in the Supreme Court of Bangladesh but they are not getting enough space to sit in.

 

Due to huge numbers of member, the premises of the Supreme Court has failed to accommodate all of them. These numbers of member and clients are making tremendous pressure on the current resources. They are using number of articles, i.e. food containers, varieties of bottles, cigarettes and other wastes. Amongst these, cigarette causes huge nuisance and health hazards in the court premises though smoking in the public place has been prohibited by Smoking and Tobacco Products Usages (Control) Act, 2005 (amended in 2013) and subsequently, the Rules, 2015 was framed

Public Place has been defined in section 2 of the Act, 2005 in the following terms:

()    পাবলিক প্লেসে অর্থ শিক্ষা প্রতিষ্ঠান, সরকারি অফিস, আধা-সরকারি অফিস, স্বায়ত্তশাসিত অফিস বেসরকারি অফিস, গ্রন্থাগার, লিফট, আচ্ছাদিত কর্মক্ষেত্র (indoor work place), হাসপাতাল ক্লিনিক ভবন, আদালত ভবন, বিমানবন্দর ভবন, সমুদ্রবন্দর ভবন, নৌ-বন্দর ভবন, রেলওয়ে স্টেশন ভবন, বাস টার্নিমাল ভবন, প্রেক্ষাগৃহ, প্রদর্শনী কেন্দ্র, থিয়েটার হল, বিপণী ভবন, চতুর্দিকে দেয়াল দ্বারা আবদ্ধ রেস্টুরেন্ট, পাবলিক টয়লেট, শিশুপার্ক, মেলা বা পাবলিক পরিবহনে আরোহণের জন্য যাত্রীদের অপেক্ষার জন্য নির্দিষ্ট সারি, জনসাধারণ কর্তৃক সম্মিলিতভাবে ব্যবহার্য অন্য কোন স্থান অথবা সরকার বা স্থানীয় সরকার প্রতিষ্ঠান কর্তৃক, সাধারণ বা বিশেষ আদেশ দ্বারা, সময় সময় ঘোষিত অন্য যে কোন বা সকল স্থান

Section 4 of the Act, 2005 has prohibited smoking in the public place and public transport and imposed fined Tk.300/- for smoking in the public place and public transport.

৪৷    () ধারা এর বিধান সাপেক্ষে, কোন ব্যক্তি কোন পাবলিক প্লেস এবং পাবলিক পরিবহণে ধূমপান করিতে পারিবেন না৷
(
) কোন ব্যক্তি উপ-ধারা () এর বিধান লঙ্ঘন করিলে তিনি অনধিক তিনশত টাকা অর্থদণ্ডে দণ্ডনীয় হইবেন এবং উক্ত ব্যক্তি দ্বিতীয়বার বা পুনঃ পুনঃ একই ধরণের অপরাধ সংঘটন করিলে তিনি পর্যায়ক্রমিকভাবে উক্ত দণ্ডের দ্বিগুণ হারে দণ্ডনীয় হইবেন

In section 7 and 7(Ka) of the Act, smoking is permitted in designated places in the prohibited areas.

৭৷    () কোন পাবলিক প্লেসের মালিক, তত্ত্বাবধায়ক বা নিয়ন্ত্রণকারী ব্যক্তি বা ব্যবস্থাপক উহাতে এবং কোন পাবলিক পরিবহণের মালিক, তত্ত্বাবধায়ক, নিয়ন্ত্রণকারী ব্যক্তি বা ব্যবস্থাপক উহাতে ধূমপানের জন্য স্থান চিহ্নিত বা নির্দিষ্ট করিয়া দিতে পারিবেন৷
(
) কোন পাবলিক প্লেস বা পাবলিক পরিবহণে ধূমপানের স্থানের সীমানা, বর্ণনা, সরঞ্জাম এবং নিরাপত্তা ব্যবস্থা বিধি দ্বারা নির্ধারিত হইবে৷

৭ক () এই আইনের উদ্দেশ্য পূরণকল্পে, প্রত্যেক পাবলিক প্লেস বা পাবলিক পরিবহনের মালিক, তত্ত্বাবধায়ক, নিয়ন্ত্রণকারী ব্যক্তি বা ব্যবস্থাপক বিধি দ্বারা নির্ধারিত দায়িত্ব পালন করিবেন
(
) উপ-ধারা () এর অধীন প্রণীত বিধির বিধান লঙ্ঘন করিলে তিনি অনধিক পাঁচশত টাকা অর্থদণ্ডে দণ্ডনীয় হইবেন

It is an overwhelming duty upon the authority of the institution to put warning sign board in the public place and public transport in accordance with section 8 of the Act. Otherwise, the authority would be fined for violation of putting warning sign board in the institution.

৮৷     () ধারা এর অধীন ধূমপান এলাকা হিসাবে চিহ্নিত বা নির্দিষ্ট স্থানের বাহিরে প্রত্যেক পাবলিক প্লেসের মালিক, তত্ত্বাবধায়ক, নিয়ন্ত্রণকারী ব্যক্তি বা ব্যবস্থাপক উক্ত স্থানের এক বা একাধিক জায়গায় এবং পাবলিক পরিবহণের মালিক, তত্ত্বাবধায়ক, নিয়ন্ত্রণকারী ব্যক্তি বা ব্যবস্থাপক সংশ্লিষ্ট যানবাহনে ধূমপান হইতে বিরত থাকুন, ইহা শাস্তিযোগ্য অপরাধ সম্বলিত নোটিশ বাংলা এবং ইরেজী ভাষায় প্রদর্শন করিবার ব্যবস্থা করিবেন৷
(
) কোন পাবলিক প্লেস বা পাবলিক পরিবহনের মালিক, তত্ত্বাবধায়ক বা নিয়ন্ত্রণকারী ব্যক্তি বা ব্যবস্থাপক উপ-ধারা () এর বিধান লঙ্ঘন করিলে তিনি অনধিক এক হাজার টাকা অর্থদণ্ডে দণ্ডনীয় হইবেন এবং উক্ত ব্যক্তি দ্বিতীয়বার বা পুনঃ পুনঃ একই ধরণের অপরাধ সংঘটন করিলে তিনি পর্যায়ক্রমিকভাবে উক্ত দণ্ডের দ্বিগুণ হারে দণ্ডনীয় হইবেন

The Supreme Court of Bangladesh and the Supreme Court Bar Association are under an obligation to comply with the provisions of the Act, 2005. Currently, there is no warning sign board of prohibiting smoking you could find in the court premises. Moreover, no designated place for smoking has yet been built up in the court and

bar premises. It is, therefore, smoking in the court and the bar premises is open to all. This vital issue has not yet been addressed by the court and the bar authority since passing of the Act, 2005.

The lawyers, clerks, officials and court visitors are freely and openly smoking in the court and the bar premises. Astonishingly, cigarettes are sold openly within the bar premises.

Since enactment of the Act, 2005, the court and the bar authorities have, surprisingly, been remained silent in taking appropriate measures to comply with the provisions of the Act, 2005. Now the question is who will make both the authorities to compel to comply with the provisions of the Act, 2005. We have no suggestions at all in this regard but the authorities know the best how to comply with the provisions of the Act, 2005.
